DJPORT Terms of Use

These Terms govern the use of DJPORT, User Accounts, music functions, DJPORT Transfer, payments and materials made available by the community.

DJPORT Is Not a Music Store. The charge covers a data transfer package and technical download handling. It is not the price of a track and does not transfer any licence or copyright.

1Definitions and General Provisions

  1. Serwis lub DJPORT — portal internetowy dostępny w domenie DJPORT wraz z podstronami, aplikacją PWA i udostępnianymi funkcjami.
  2. Użytkownik means a natural person, legal person or organisational unit using the Service. Account means individual access to functions that require login.
  3. Materiał means a track, recording, remix, edit, bootleg, set, artwork, description, metadata or other content submitted or made available through the Service.
  4. DJPORT Transfer means a technical data balance used to handle MP3 and ZIP downloads. Program Rozliczeń means the voluntary royalty programme for eligible producers and labels.
  5. By using a function that requires acceptance of the Terms, creating an Account, purchasing transfer or submitting Material, the User confirms that they have read the applicable rules.

2Nature of DJPORT

  1. DJPORT is a technical platform, music catalogue and electronic service for DJs, producers, labels and people searching for music and its different versions.
  2. The Service enables, among other things, cataloguing, searching, previewing, identification, creation of playlists and sets, and technical downloading of Materials.
  3. Materials may be stored and transmitted using external cloud infrastructure used by DJPORT, including Cloudflare R2/CDN, hosting and other technical providers.
  4. For Materials submitted by Users, DJPORT provides technical storage, cataloguing and information-sharing services at their request. The person submitting Material decides to provide it and is responsible for holding the required rights.
  5. The above reservation does not apply to Materials published directly by DJPORT. Liability for such content is assessed under applicable law.

3Registration and Account

  1. Registration is voluntary, but downloads, Favorites, playlists, STUDIO, FLOW, DJPORT ID, music submissions and other selected functions may require login and satisfaction of additional conditions.
  2. A standard DJPORT Account does not require a first name, surname or address. The basic data are an email address and a stage name or username.
  3. The User provides accurate data to the extent required by the Service, protects their password and is responsible for actions performed through the Account unless they occurred through no fault of the User.
  4. Each User may hold one Account. Creating multiple Accounts to circumvent restrictions, obtain bonuses repeatedly or manipulate statistics is prohibited.
  5. DJPORT may restrict functions, suspend or delete an Account used unlawfully, threatening security or violating the Terms. Where possible, the User will be informed of the reason and the opportunity to provide an explanation.
  6. Usunięcie Konta można zgłosić przez funkcję w panelu albo na [email protected]. Dane wymagane do rozliczeń, obowiązków prawnych, bezpieczeństwa i obrony przed roszczeniami mogą być przechowywane przez odpowiedni okres.

4Rules of Use and Music Functions

  1. The User must use DJPORT in accordance with the law, the Terms, the purpose of the Service and third-party rights.
  2. Unlawful, spam-related, fraudulent or security-threatening activities, circumvention of limits, automatic generation of artificial traffic and manipulation of plays, downloads, rankings or royalties are prohibited.
  3. DJPORT FLOW, STUDIO, DJ Charts, Trend Radar, Transition Finder and recommendations are supporting functions. Results depend on metadata and activity within the Service; DJPORT does not guarantee complete accuracy.
  4. DJPORT ID uses the microphone only after device permission and sends a short sample to an audio-recognition provider, in particular ACRCloud, for identification. The function does not guarantee identification of every recording.
  5. Previews, search, FLOW and DJPORT ID do not reduce DJPORT Transfer, although full access may require login and a positive balance.

5DJPORT Transfer and Payments

  1. DJPORT does not sell tracks. Payment covers a data package and the technical preparation and downloading of files from infrastructure used by the Service.
  2. The balance is maintained in bytes and displayed in MB or GB. 1 MB means 1,048,576 bytes and 1 GB means 1,024 MB. A package does not correspond to a specific number of tracks.
  3. For an individual download, the actual size of the prepared MP3 including metadata and technical markings is deducted; for a batch download, the actual size of the completed ZIP including supporting files is deducted.
  4. The system checks the balance before providing a file. If it is insufficient, the download does not start. The balance is reduced immediately before technical delivery of the file or pack.
  5. Wcześniej kupiony stały transfer pozostaje jako Legacy Transfer. Nowe konta i nowe zakupy korzystają z modelu FREE / PREMIUM.
  6. Packages are not subscriptions and do not renew automatically. Each payment is initiated by the User and processed by PayU or PayPal.
  7. DJPORT Transfer is not electronic money, a payment instrument or an investment product; it may not be resold, paid out in cash or transferred to another Account except where required by law.
  8. A download interrupted due to the User’s device, browser or connection does not result in an automatic balance refund. A confirmed error on the DJPORT side may be submitted as a complaint.

6Consumers and Right of Withdrawal

  1. Before payment, the User receives information about the selected package, price and transfer calculation method and accepts the Terms and Privacy Policy.
  2. A consumer may exercise the right to withdraw from a distance contract under applicable law.
  3. If a Consumer requests that the service begin before the withdrawal period expires and starts using transfer, they may be charged for the part of the service supplied before withdrawal to the extent permitted by law.
  4. No provision of the Terms limits consumer rights or DJPORT liability that cannot be excluded by contract.

7Copyright and Use of Materials

  1. Rights in tracks and recordings remain with their authors, performers, producers, publishers, labels or other entitled parties.
  2. Purchasing transfer, previewing or downloading does not transfer any licence, economic copyright, related rights, producer rights or other intellectual property rights.
  3. A download does not constitute permission for public performance, distribution, further sharing, reproduction, remixing or commercial use. The User must obtain any permissions required to use Material outside the Service.
  4. User Materials are published on the basis of their rights declarations. Detailed submission conditions are set out in the Music Submission Terms.

8Reporting Infringements and Moderation

  1. Zgłoszenia bezprawnych treści i naruszeń praw należy kierować na [email protected] albo przez contact form.
  2. A notice should include the exact address or location of the Material, a description and grounds of the infringement, the reporter’s contact details, any proof of authority and a good-faith declaration.
  3. After receiving a sufficiently precise and credible notice, DJPORT may immediately hide, block or remove Material while it is reviewed and request documents or explanations from the User.
  4. Where possible, DJPORT confirms receipt of a notice and informs the interested parties of its decision. The User may submit an explanation or complaint about the decision to [email protected].
  5. DJPORT is under no general obligation to monitor all User information in advance, but responds to specific knowledge and credible notices in accordance with applicable law.

9Liability and Availability

  1. DJPORT liability for Materials stored at Users’ request is assessed according to the actual nature of the service and the rules governing intermediary services.
  2. DJPORT may conduct moderation and technical checks but does not guarantee prior detection of every infringement and does not automatically verify rights to every Material.
  3. The Service may be temporarily unavailable due to failures, maintenance, hosting, Cloudflare, CDN, payment operators or another provider. DJPORT takes reasonable steps to restore functionality.
  4. DJPORT does not guarantee continued availability of specific Material because it may be withdrawn by an entitled party, removed, blocked or moved.
  5. Exclusions and limitations of liability do not apply to intentionally caused damage or liability that cannot be excluded by law.

10Complaints, Privacy and Contact

  1. Reklamacje dotyczące transferu, płatności, Konta i funkcji technicznych należy przesyłać na [email protected], podając e-mail lub pseudonim Konta, opis, datę zdarzenia oraz — jeżeli dotyczy — numer płatności, nazwę pliku albo historię operacji.
  2. A complete complaint is handled without undue delay, generally no later than within 14 days unless the law provides another period.
  3. Zasady przetwarzania danych opisuje Polityka prywatności i RODO, a szczegółowy sposób składania spraw — dokument Complaints and Reports.
  4. For royalty payments, DJPORT may require identification, tax and settlement data and a correctly issued VAT invoice or another permitted document agreed for the relevant settlement.

11Final Provisions

  1. DJPORT may develop, change or withdraw functions while respecting acquired rights and mandatory law.
  2. The Terms may be amended for important legal, technical, security or Service-development reasons. Material changes affecting registered Users will be communicated through the Service or by email with appropriate notice where required.
  3. Matters not governed by these Terms are subject to Polish law, without depriving consumers of protection granted by mandatory provisions.
